Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of dynamimix.com (the “Site”) and your purchase of either:

• Templates — pre-built digital website templates sold on the Site, or
• Services — custom branding, web design, and development work performed by Dynamimix.

By using the Site, purchasing a Template, or engaging Dynamimix for Services, you agree to these Terms.

2. Templates — Purchase, Payment, and Delivery

2.1 What you’re buying

Each Template purchase grants a license to use a pre-built Squarespace website design on one website (see Section 3 for full license terms).

2.2 Payment and Merchant of Record

Template purchases are processed through Polar.sh, which acts as the Merchant of Record for these transactions. This means Polar.sh, not Dynamimix, is the legal seller of record on your purchase, and Polar.sh is responsible for calculating, collecting, and remitting applicable sales tax, VAT, and GST on Template purchases in the jurisdictions it supports. Templates are available for purchase by customers worldwide.

2.3 Delivery process

After completing checkout, Dynamimix will prepare your Template as a new Squarespace site. Within 24 hours, you will receive a contributor invite to the Squarespace account email address provided at checkout. Accepting this invite grants you access to your new Squarespace site with the Template pre-installed.

If you do not already have a Squarespace account, accepting the invite creates one for you. This is a digital product, so nothing physical ships. An active Squarespace plan is required to publish your site live. Squarespace subscription costs are not included in the Template purchase price, nor is a domain if you don’t already own one.

2.4 Ownership after delivery

Once your Squarespace site has been delivered via contributor invite, that site instance belongs to you. If Dynamimix later updates, modifies, retires, or stops selling the Template design, your already-delivered site is unaffected — you keep full access to and control of your site exactly as delivered.

This ownership of your individual site is separate from ownership of the underlying Template design. The design itself remains Dynamimix’s intellectual property, licensed to you under the terms in Section 3.

This ownership is independent of the support window described in Section 2.6. Once that window has closed, your delivered site remains fully yours to keep and use, but further assistance from Dynamimix is offered at our discretion rather than as a guaranteed part of your purchase.

2.5 What’s included

Each Template includes the pages and sections listed on its product page at the time of purchase. AI-generated demo images (Adobe Firefly) and licensed stock images (Pexels, Unsplash) are included with your purchase. Logo elements shown in demos are placeholders only and are not included.

2.6 Support

Each Template purchase includes 60 days of email support from the date of purchase, scoped to questions related to using and customizing your Template. This does not include general Squarespace platform support or open-ended customization coaching.

2.7 Refunds

All Template sales are final, with the exception of Dynamimix-side fulfillment errors. Polar.sh, as Merchant of Record, may also independently issue refunds in limited circumstances. Full detail is available in our Refund Policy.

3. Template Licensing

3.1 License grant

Purchasing a Template licenses it for use on one website only — either your own business’s site or a single client’s site. This includes full editing access to customize every page, section, and image.

This license does not permit reusing the Template across more than one website or client project, or reselling, redistributing, or repackaging the Template itself, in whole or in part, in any form.

3.2 Multiple sites or client projects

If you need to use a Template for more than one website or client project, contact us at [email protected] before doing so, and we’ll help you find the right option. Using a Template across multiple sites without such an arrangement is a violation of this license.

3.3 Intellectual property

Dynamimix retains all ownership and intellectual property rights in the Template design itself. Your purchase grants a license to use the design under the terms above; it does not transfer ownership of the underlying design, code structure, or visual system.

3.4 No affiliation with Squarespace

Dynamimix and its Templates are not affiliated with, endorsed by, or sponsored by Squarespace, Inc. “Squarespace” is a registered trademark and the property of Squarespace, Inc.

4. Services — Branding, Web Design, and Development

4.1 Scope

Services are scoped and agreed to individually per project, typically following an initial inquiry, discovery conversation, and proposal. Specific project scope, timeline, and pricing are confirmed in writing before work begins.

4.2 Payment and cancellation

Payment terms, deposit requirements, and cancellation terms for Services are set out in each project’s individual proposal or agreement.

4.3 Ownership of deliverables

Ownership of final Services deliverables transfers to the client upon full payment, unless otherwise agreed in the project proposal. Dynamimix retains the right to display completed work in its own portfolio unless otherwise agreed with the client.

5. Account and Eligibility

By using the Site or purchasing from Dynamimix, you represent that you are at least 18 years old, or the age of majority in your jurisdiction, and have the legal capacity to enter into these Terms.

6. Limitation of Liability

To the fullest extent permitted by law, Dynamimix’s total liability arising out of or related to your purchase of a Template or engagement of Services shall not exceed the amount you paid for that specific Template or Service. Dynamimix is not liable for indirect, incidental, or consequential damages, including lost profits or business interruption.

7. Disclaimer of Warranties

Templates and Services are provided “as is.” Dynamimix does not guarantee that a Template will be error-free, uninterrupted, or compatible with future versions of Squarespace beyond what’s stated on the product page at time of purchase.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

9. Changes to These Terms

Dynamimix may update these Terms, Template pricing, or Template availability at any time. Material changes will be reflected on this page with an updated “Last updated” date. Continued use of the Site or future purchases after changes are posted constitutes acceptance of the updated Terms.

10. Dispute Resolution

If a dispute arises, we encourage you to contact us directly at [email protected] first so we can work toward a resolution informally before pursuing any other action.
